Employers that must be OFCCP compliant are required to adopt hiring practices that
do not discriminate on grounds of race, color, religion, sex or national origin.
Any employer, but especially those required to be compliant, should implement selection
procedures that reduce to the greatest extent possible any likelihood of bias in
employment decisions.
One solution available to employers to limit the introduction of bias in the selection
process is a valid pre-employment testing program. Pre-employment testing can help
employers improve overall operations performance by identify applicants that have
the mental abilities and personality traits needed to successfully perform a job.
An additional benefit is that well designed pre-employment tests that are properly
validated can help employers avoid instances of disparate impact that often result
in costly OFCCP audits and expensive fines.
